TERMS OF SERVICE FOR “THE DIY PROTECTION ORDER APPLICATION COURSE ”

1. DEFINITIONS

1.1 We / Us / Our/The Company: Naomi Cramer.

1.4 You / Your: The person or entity accessing, purchasing, or using the Course.

1.5 The Course / Program: The digital course titled “The DIY Protection Order Program”, and all associated digital assets, templates, materials, videos, audios, documents, examples, and related services offered on the Site.

1.6 Site / Website: The website through which the Course is offered.

2. OVERVIEW & ACCEPTANCE OF TERMS

2.1 This Site is operated by Naomi Cramer. Throughout these Terms, “we,” “us,” and “our” and “Naomi Cramer” may be referred to as to the Company. By accessing or using the Site or the Course, purchasing the Course, or otherwise using our services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to all of these Terms, do not access or use the Site or purchase the Course.

2.2 We may update these Terms from time to time. Any updated Terms will be posted on the Site with a revised “Last Updated” date. Your continued use of the Site or the Course after changes are posted constitutes acceptance of those changes.

2.3 The Course is delivered via an e-commerce/learning platform (Systeme.io). We rely on that platform to host and deliver Course content; platform-specific terms and privacy policies may also apply.

3. ONLINE STORE TERMS

3.1 Eligibility. By purchasing or using the Course you represent and warrant that you are at least 18 years of age and have capacity to enter into these Terms. If you are accepting these Terms on behalf of an entity, you represent that you have authority to bind that entity.

3.2 Lawful Use. You may not use our products or services for any unlawful purpose. You must not use the Course or Site to engage in activities that violate any applicable laws or regulations.

3.3 Security. You must not transmit any harmful code, virus, spyware, or other malicious software to the Site or Course. Any breach of Site security or misuse of the Course may result in immediate suspension or termination of your access.

4. THE DIY PROTECTION ORDER PROGRAM — COURSE TERMS

4.1 Educational Purpose & No Legal Advice

4.1.1 This course is to offer you guidance in applying for a protection order. It is designed to apply for a protection order and does not cover anything after you have submitted/lodged/filed your application. It does not cover any other family court orders such as but not limited to a dissolution of marriage or an order to settle a dispute between guardians.

4.1.2 The Course is provided for educational and informational purposes only. It does not constitute legal advice and does not create a solicitor-client or other professional relationship between you and the Company.

4.1.3 The Course content is general in nature and is not tailored to your individual circumstances. You should obtain independent legal advice about your specific situation.

4.1.4 The Course is not regulated by any legal authority in New Zealand. The Company and/or Naomi Cramer does not hold themselves out as a licensed solicitor for jurisdictions where they are not licensed.

4.2 License & Intellectual Property

4.2.1 License Grant. Upon purchase of the Course, the Company grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Course materials for your personal, non-commercial use for a period of twelve (12) months from the date of purchase, unless otherwise expressly agreed in writing.

4.2.2 Ownership & Copyright. All Course materials, content, text, graphics, images, videos, audio, templates, sample documents and other materials provided as part of the Course are and remain the sole and exclusive property of Naomi Cramer. All copyright, database rights, moral rights and other intellectual property rights in and to the Course materials are owned by the Company.

4.2.3 No Transfer of Ownership. By accessing, viewing, or downloading Course materials you do not acquire any ownership or other rights in the Course materials beyond the limited license expressly granted in clause 4.2.1. No transfer of ownership is to be construed by virtue of access or purchase.

4.2.4 Permitted Use & Restrictions. You may use the Course materials only as expressly allowed in these Terms. You must not copy, reproduce, distribute, share, sell, rent, lease, sublicense, upload, publicly display, publicly perform, create derivative works of, or otherwise exploit the Course materials, in whole or in part, for any commercial purpose or third party, without the Company’s prior written consent. Any unauthorized use is strictly prohibited and may result in termination of your license and legal action.

4.3 No Guarantees or Warranties; Access Period

4.3.1 Except where expressly stated, the Course is provided on an “as is” and “as available” basis without any warranties, representations or conditions of any kind, whether express or implied. To the fullest extent permitted by law, the Company disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

4.3.2 You acknowledge that your reliance on the Course materials is at your sole risk. The Company makes no guarantee regarding any legal outcomes or the suitability of the Course for your particular circumstances.

4.3.3 Access Period. Access to the Course materials is limited to twelve (12) months from the date of purchase unless we expressly agree otherwise in writing.

4.4 No Refunds / Digital Sales Final

4.5.1 Because the Course and its materials are delivered digitally and become immediately accessible following purchase, all sales are final.

4.5.2 No refunds, credits, returns, or exchanges will be offered for any reason, including (without limitation) dissatisfaction with the Course, inability to access materials, technical issues outside the Company’s control, change of mind, or purchaser error. By completing purchase you acknowledge and accept this no-refund policy.

5. BILLING, ACCOUNT INFORMATION & PURCHASE TERMS

5.1 Order Acceptance & Cancellation. We reserve the right to refuse or cancel any order for any reason, including but not limited to limits on quantities, errors in product or pricing information, suspected fraud, or problems identified by our payment processor.

5.2 Accuracy of Information. You agree to provide accurate and complete billing and account information and to update that information promptly when it changes. You are responsible for all activity on your account.

5.3 Prices & Changes. All prices are subject to change without notice. The price charged for a Course purchase will be the price in effect at the time of purchase, unless we notify you otherwise.

5.4 Communications. By enrolling in the Course, you consent to receive course-related communications from us. This includes an initial onboarding and support email sequence, which may include a minimum of five emails, some of which may contain information about related products, services, or offers that may support your learning experience. You may opt out of receiving promotional communications at any time by using the unsubscribe link provided in those messages. However, you will continue to receive important non-promotional notices, such as messages regarding course access, account administration, or billing, as these are necessary to deliver the Course.

5.5 Accuracy of Email Address and Access Credentials.

You agree to provide a truthful, complete, and accurate email address at the time of checkout. This email address will serve as your primary login credential to access the course and all related materials. Access will not be granted to any individual providing false, incomplete, or inaccurate email information. We accept no responsibility for any inability to access the course, missed communications, or other issues arising from inaccurate, outdated, or falsified email addresses. It is your sole responsibility to ensure the email provided is valid and accessible.

6. OPTIONAL TOOLS & THIRD-PARTY LINKS

6.1 Third-Party Tools. The Company may provide tools, integrations, or links to third-party services or content. Such third-party tools are provided “as is” and the Company makes no representations or warranties regarding those tools. Use of third-party tools is at your own risk and subject to the third party’s terms and privacy policy.

6.2 External Links. The Site may contain links to websites of third parties. The Company is not responsible for the content, security, accuracy, or practices of any third-party sites. You should review the terms and privacy policies of third-party sites before using them.

7. USER SUBMISSIONS, COMMENTS & FEEDBACK

7.1 Consent to Use. By submitting comments, feedback, questions, or other content to the Company, you grant the Company a perpetual, irrevocable, worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute and display the submission in any media. If you do not want the Company to use your submission in this way, do not submit it.

7.2 Responsibility for Content. You are solely responsible for any content you submit and must ensure your submissions do not violate any law or third-party rights (including privacy and intellectual property rights). You must not submit defamatory, obscene, abusive, infringing, or otherwise unlawful material.

7.3 Moderation & Removal. The Company reserves the right to monitor, review, edit, refuse, or remove any user submissions at its sole discretion and without notice.

8. DISCLAIMERS, LIMITATION OF LIABILITY & FORCE MAJEURE

8.1 Disclaimer of Warranties

8.1.1 No Guarantee. We make no representations or warranties that the Course will meet your requirements, will be uninterrupted, timely, secure, or error-free, or that errors will be corrected.

8.1.2 Risk of Use. Your use of the Site and the Course is at your sole risk. All materials and services are provided “as is” without warranty of any kind.

8.2 Limitation of Liability

8.2.1 To the maximum extent permitted by law, Naomi Cramer, the Company, its officers, directors, employees, agents, affiliates and licensors shall not be liable for any indirect, incidental, special, consequential or exemplary damages, including but not limited to loss of profits, loss of data, loss of business, or loss of goodwill, arising out of or in connection with these Terms, the Site, or the Course, even if the Company has been advised of the possibility of such damages.

8.2.2 Where liability cannot be excluded by applicable law, the Company’s total aggregate liability to you for any claim arising out of or relating to these Terms, the Site or the Course shall be limited to the amount actually paid by you to the Company for the Course in the six (6) months preceding the event giving rise to the claim.

8.3 Force Majeure

8.3.1 The Company will not be liable for any failure or delay in performance caused by acts beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, strikes, acts of government, failures of telecommunications or power networks, or platform outages.

9. INDEMNIFICATION

9.1 You agree to indemnify, defend and hold harmless Naomi Cramer, and her respective officers, directors, employees, agents and affiliates from and against any claims, liabilities, losses, damages, costs and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your use of the Site or Course; (c) your submissions or communications; or (d) your violation of any applicable law or the rights of any third party.

10. TERMINATION

10.1 Termination Rights. The Company may suspend or terminate your access to the Site and the Course at any time for any reason, including if you breach these Terms.

10.2 Outstanding Obligations. Termination does not relieve you of any payment or other obligations incurred prior to termination. Sections that by their nature should survive termination (including but not limited to ownership, disclaimers, indemnities, limitation of liability, and governing law) will survive.

11. SEVERABILITY

11.1 If any provision of these Terms is held to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision will be severed and the remaining provisions will continue in full force and effect.

12. GOVERNING LAW & JURISDICTION

12.1 These Terms of Service and any dispute arising from or related to them shall be governed by and construed in accordance with the laws of New Zealand . You agree to submit to the exclusive jurisdiction of the New Zealand courts for resolution of any disputes, subject to any mandatory legal rights you may have under applicable law.

13. AMENDMENTS TO THESE TERMS

13.1 We reserve the right to amend these Terms at any time. Where material changes are made, we will post the updated Terms on the Site and indicate the “Last Updated” date. Your continued use of the Site or Course after changes are posted constitutes acceptance of the updated Terms.

14. MISCELLANEOUS DISCLAIMERS

14.1 No Affiliation.
The Course is not affiliated with, endorsed by, or associated with any court, government agency, regulatory body, or official authority in New Zealand or any other jurisdiction.

14.2 Educational and Informational Purposes Only.
All Course content, including any explanations, examples, demonstrations, or guidance regarding legal concepts or documents, is provided solely for general educational and informational purposes. It is not legal advice, is not tailored to your circumstances, and should not be relied upon as a substitute for obtaining independent legal advice.

14.3 No Lawyer–Client Relationship.
Your enrolment in or use of the Course does not create a lawyer–client relationship between you and the Company or any instructor, even if an instructor holds a current practising certificate as a barrister and solicitor of the High Court of New Zealand. Any such individuals participate in an educational capacity only, not in a professional legal capacity.

14.4 No Personalised Legal Services.
The Company does not provide legal representation, legal drafting services, legal opinions, or personalised legal advice. If you require advice tailored to your specific circumstances, you should engage an independent lawyer.

14.5 Templates and Examples.
Templates, sample documents, checklists, and examples included in the Course are provided for educational purposes only. You are solely responsible for reviewing, modifying, and ensuring the suitability of any template for your own circumstances. The Company accepts no liability for any use, misuse, or adaptation of templates or examples.

14.6 Responsibility for Your Own Decisions.
You remain fully responsible for any decisions you make, documents you prepare or use, and actions you take based on the Course content. The Company is not liable for any loss, error, or consequence arising from your reliance on the Course materials.
